Terms of Use — M4th3m4t1c4

These Terms of Use ("Terms") govern your use of M4th3m4t1c4 (the "App"), available on Android and iOS. The App is operated by an individual developer ("we", "us", or "our"). By installing, copying, or otherwise using the App, you agree to these Terms. If you do not agree, do not install or use the App.
1. Who these Terms apply to
The App is designed for children learning math. A parent, legal guardian, or other responsible adult ("you") must install the App, agree to these Terms on behalf of yourself and the child, and supervise the child's use of the App. By agreeing to these Terms, you confirm that you are at least 18 years old and have authority to accept these Terms.
The App does not collect names, emails, or any contact information. Your purchase receipt and anonymous usage data are governed by our Privacy Policy, which is incorporated into these Terms by reference.
2. License to use the App
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, for personal, non-commercial, educational use by you and your child.
You may not: sell, rent, lease, or commercially exploit the App; reverse engineer it except where prohibited restrictions are unlawful; remove proprietary notices; use the App unlawfully; or use bots/scrapers/scripts to access the App.
3. App content and educational purpose
The App provides math practice (addition, subtraction, multiplication, division) as supplementary practice. It is not a substitute for school instruction or professional tutoring. Content may contain errors. We do not guarantee any specific learning outcome.
4. In-app purchases
The App is free to download. It offers an optional one-time lifetime unlock ("M4th3m4t1c4 Pro"):

Both unlock the same content.
4.1 What you are buying
- A non-consumable, one-time In-App Purchase ("IAP"). You pay once and own the unlock forever on the Apple/Google account you used.
- No subscriptions, no auto-renewals, no recurring charges, and no free trials.
- The unlock is tied to the Apple/Google account. Restore via Settings → "Restore purchases" or by signing into the same store account.
4.2 Payments
Payment is processed by Apple App Store or Google Play. We never see your card number or billing address.
4.3 Refunds
Once unlock content is delivered, the IAP is generally non-refundable. Request refunds through Apple (reportaproblem.apple.com) or Google Play help. Statutory refund rights (e.g. EU consumer law) are not affected.
4.4 Price changes
We may change IAP prices at any time. Price changes do not affect purchases you have already made.
5. Subscription-style terminology
Although stores sometimes use the term "entitlement", products in the App are not subscriptions — they are non-recurring, one-time, lifetime IAPs.
6. Intellectual property
The App — including code, design, graphics, audio, illustrations, problem sets, and the "M4th3m4t1c4" name and logo — is owned by us or our licensors. The license in §2 does not transfer ownership.
7. Third-party services
The App relies on Apple App Store / Google Play, RevenueCat, Amplitude, and Firebase Crashlytics. Their terms and privacy policies apply in addition to these Terms.
8. Updates
We may release updates that add, change, or remove features, or fix bugs. We are not obligated to maintain any particular version indefinitely.
9. No warranty
To the maximum extent permitted by law, the App is provided "as is" and "as available", without warranty of any kind, including merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, or educational outcomes.
10. Limitation of liability
To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of data/profit/opportunity/goodwill. Where liability cannot be excluded, our total liability is limited to the amount you actually paid us for the App in the 12 months before the claim ( €0 for the free tier). Liability that cannot be limited under law (e.g. death/personal injury from negligence, or fraud) is not excluded.
11. Indemnification
You agree to indemnify and hold us harmless from claims arising out of your (or your child's) breach of these Terms or misuse of the App, to the extent permitted by law.
12. Termination
You may stop using the App by uninstalling it. We may suspend or terminate access for breach or if we discontinue the App. Upon termination, the license in §2 ends; surviving sections include IP, warranty, liability, indemnification, and governing law.
13. Changes to these Terms
We may update these Terms from time to time. Material changes will be made visible in the App. Continued use after a change means you accept the updated Terms.
14. Governing law and disputes
These Terms are governed by the laws of Slovenia. Mandatory consumer-protection rights in your country of residence are not removed. We will first try to resolve disputes informally via email; if unresolved within 60 days, either party may bring formal proceedings.
